Criminalization of Employment Law: A New Risk for Managers?

In the 1990s, there was a growing concern about the "criminalization" of corporate law, in part justified by the passage of the Sarbanes-Oxley Act, which placed real criminal risks on top managers. While Sarbanes-Oxley was no threat to HR managers at first, innovative prosecutors and plaintiffs’ attorneys are changing that, and courts are beginning to allow longstanding criminal laws to be applied to store managers and HR managers. The prolabor Obama administration and the U.S. Department of Justice support this trend. Read more

New White Paper: A Guide to Obama’s Health Care Reform

After more than a year of heated debate, President Obama signed into law the Patient Protection and Affordable Care Act. The Health Care and Education Affordability Reconciliation Act of 2010, a compromise bill designed to provide a package of "fixes" to the Senate’s original bill, followed soon after. Together, the two pieces of legislation expand federal involvement in and control over the health insurance and health care industries to an unprecedented degree. Read on

Question on Person Working Another Job

Employers Forum Question I have a employee who apparently is working another job at night and works for us during the day. We have lots of people that work other jobs. However, He made the comment to a Supervisor that he was so sleepy he could barely stay awake. My problem is he is a forklift driver. If he falls asleep on job, we could have someone hurt or himself. Has anyone ever had to deal with anything like this? Read more

All Eyes on Arizona

Arizona’s new immigration law, Senate Bill (SB) 1070, authorizes state and local law enforcement officials to inquire into the immigration status of any person "where reasonable suspicion exists that the person is an alien who is unlawfully present in the United States." The law regulates aliens directly, not by means of the employer-employee relationship. Nevertheless, many people believe that the new law is preventing employers from hiring Hispanic workers for fear of workplace disruption. Read more

The Michael Scott School of Business

Litigation Value: An education on management from the master (of disaster) -- priceless. The Office didn’t air in my little corner of the world last night, and I’m currently battling symptoms of withdrawal. So I decided to take a little walk down memory lane and relive some of my favorite lessons from Season 6. Remember, back in Season 2, when Michael gave Ryan the benefit of his many years of management experience through a series of cliches? What lessons would Michael share with us from this season? 2010 Employment Law Guide

Employers saw sweeping new employment law changes in 2009 and more are on the way for 2010. The push for same-sex partner benefits in the workplace is gaining momentum (President Obama recently extended benefits to same-sex partners of federal employees), EFCA could rear its ugly head after Congress passes health care reform, and the Healthy Families Act could require employers with 15 or more employees to provide seven paid sick days a year to employees working 30 or more hours a week. And there's more to come. Read more

The Wedding, Part II

2010-07-23 05:40

Well, it’s a little difficult to write about the perils of working in Scranton with Michael Scott as your boss when the entire office is attending a wedding, but here goes. After watching last night's repeat episode of Jim's and Pam's wedding, I can’t say that getting married to a coworker is always a bad thing (I met my wife when I was clerking for a company after my second year of law school, and we will celebrate our 15th wedding anniversary next month, and as Chris Rock has joked, "If my dad hadn’t sexually harassed my mom, I wouldn’t be here")...

By Dominique Launay Dealing with an employee’s religious beliefs is a delicate matter, not only for employers but also for tribunals. The case Friesen v. Terminate in Haste, Regret at Leisure

Wow! It could only happen in Washington, D.C. I’m talking about the dismissal and, ultimately, attempted rehiring of Shirley Sherrod. You’ve likely heard the story by now, but it goes something like this. Last week on Monday, conservative commentator Andrew Breitbart blogged about a speech given by Sherrod, a mid-level Department of Agriculture employee...
