In the 1990s, there was a growing concern about the "criminalization" of corporate law, in part justified by the passage of the Sarbanes-Oxley Act, which placed real criminal risks on top managers. While Sarbanes-Oxley was no threat to HR managers at first, innovative prosecutors and plaintiffs’ attorneys are changing that, and courts are beginning to allow longstanding criminal laws to be applied to store managers and HR managers. After more than a year of heated debate, President Obama signed into law the Patient Protection and Affordable Care Act. The Health Care and Education Affordability Reconciliation Act of 2010, a compromise bill designed to provide a package of "fixes" to the Senate’s original bill, followed soon after. I have a employee who apparently is working another job at night and works for us during the day. We have lots of people that work other jobs. However, He made the comment to a Supervisor that he was so sleepy he could barely stay awake. My problem is he is a forklift driver. If he falls asleep on job, we could have someone hurt or himself. Has anyone ever had to deal with anything like this? Read more

Arizona’s new immigration law, Senate Bill (SB) 1070, authorizes state and local law enforcement officials to inquire into the immigration status of any person "where reasonable suspicion exists that the person is an alien who is unlawfully present in the United States." The law regulates aliens directly, not by means of the employer-employee relationship. Nevertheless, many people believe that the new law is preventing employers from hiring Hispanic workers for fear of workplace disruption. Read more |

Employers saw sweeping new employment law changes in 2009 and more are on the way for 2010. The push for same-sex partner benefits in the workplace is gaining momentum (President Obama recently extended benefits to same-sex partners of federal employees), EFCA could rear its ugly head after Congress passes health care reform, and the Healthy Families Act could require employers with 15 or more employees to provide seven paid sick days a year to employees working 30 or more hours a week.
